By creating an account or using Checkout Shield ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

3. Description of Service

Checkout Shield is a property inspection verification platform that allows users to generate GPS-stamped, timestamped photo certificates for property check-in and check-out inspections. These certificates serve as documentation tools and evidence for dispute resolution. They do not constitute legally binding proof in court without further authentication.

4. User Accounts

• -You are responsible for maintaining the confidentiality of your account credentials.
• -You must provide accurate and complete information when registering.
• -You are responsible for all activity that occurs under your account.
• -You must be at least 16 years old to use the Service.

5. Acceptable Use

You agree not to use the Service to:

• -Upload false, misleading or fraudulent inspection data
• -Violate any applicable laws or regulations
• -Infringe the intellectual property rights of others
• -Attempt to gain unauthorized access to the Service or its systems
• -Upload content depicting minors or illegal material

6. Subscription Plans and Payments

• -Checkout Shield offers free and paid subscription plans.
• -Paid plans are billed in advance on a monthly or annual basis via Stripe.
• -All prices are in USD and include applicable taxes where required.
• -We reserve the right to change pricing with 30 days' written notice to your registered email.

7. Right of Withdrawal (EU Consumers)

If you are a consumer within the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving any reason (EU Directive 2011/83/EU).

To exercise this right, contact us at checkout-shield@ezzon.nl with your account email and a clear statement of your wish to withdraw.

Upon withdrawal, we will refund the subscription fee using the same payment method within 14 days. Note: if you have actively used the Service during the withdrawal period, we may deduct a proportional amount for the service provided.

8. Refunds

Outside of the 14-day EU withdrawal right, refunds for partial subscription periods are generally not provided. If you believe you are entitled to a refund due to a service issue, contact us and we will assess your request in good faith.

9. Data and Content

• -You retain full ownership of all photos, reports, and data you upload.
• -By using the Service, you grant Checkout Shield a limited, non-exclusive license to store and process your content solely to provide the Service.
• -We may use aggregated, fully anonymized usage statistics (e.g., total number of reports generated) to improve the Service. This data cannot be traced back to individual users.

10. Limitation of Liability

To the maximum extent permitted by Dutch law:

• -The Service is provided "as is" without warranties of any kind.
• -Checkout Shield's total liability is limited to the amount you have paid for the Service in the 12 months preceding the claim.
• -We are not liable for disputes between property owners, guests, tenants, or any third parties.

This limitation does not affect your statutory rights as an EU consumer, which cannot be waived.

11. Termination

• -You may cancel your account at any time from your account settings.
• -We may suspend or terminate your account for violation of these Terms, with prior notice where practicable.
• -Upon termination, your data will be retained for 30 days (allowing recovery), then permanently deleted. Payment records are retained for 7 years as required by Dutch tax law.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands.

Any disputes shall be submitted to the competent courts in The Hague (Den Haag), Netherlands.

This does not affect your right as an EU consumer to bring proceedings in the courts of the Member State in which you are domiciled.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after that period constitutes acceptance of the new Terms. If you do not agree with the changes, you may cancel your account before the new Terms take effect.
